Upon successfully winning a VA appeal, the Department of Veterans Affairs (VA) will deduct 20% from the Veterans backpay as payment of the Veteran Claims Agent’s fees for Veteran Claims Agent’s (VCA’s) provided services.

The Veteran will Only Pay Veteran Claims Agent’s Accredited Veteran’s Claims Agent If Veteran Claims Agent’s (VCA’s) Accredited Veteran’s Claim Agent Win on the Veteran’s Appeal (VA appeal).

Veteran Claims Agent (VCA) may on a case-by-case basis, handle initial VA claims, however Veteran Claims Agent (VCA) does not charge for these services. Remember, no one can charge the Veteran for an initial VA claim filing.

No Win, No Fee: The Veteran will only pay Veteran Claims Agent (VCA) if Veteran Claims Agent (VCA) successfully adjudicated the Veterans denied VA appeal or if a clear and unmistakable error is found and leads to winning the Veterans VA appeal.

If the Veteran does not obtain an increase in the Veteran’s overall Disability Benefits Compensation from a previously denied claim which is appealed by Veteran Claims Agent (VCA); the veteran doesn’t owe or pay Veteran Claims Agent (VCA) in regards to Veteran Claims Agent (VCA) Fees.

Veteran Claims Agent (VCA) Fee is 20% of the Veterans backpay amount.

Some VA disability lawyers and/or accredited claims agents do charge more.

The Veterans fee will come straight from the Department of Veterans Affairs (VA) to Veteran Claims Agent’s (VCA’s) Accredited Veteran Claims Agent.

The Veteran won’t have to pay the Veterans fee directly out-of-pocket unless the VA fails to withhold the proper fee.

The 20% fee is a One-time payment. There are NOT reoccurring monthly fees, membership fees, or service agreements with Veteran Claims Agent (VCA).

Some cases can be taken as a flat fee after being discussed and decided on between the Veteran and the Veteran Claims Agent.

This is available in limited circumstances and only in certain types of cases. (For example, claims where the veteran is already 100% service connected, but is wanting to go after P&T (Permanent & Total) status or being paid at the 100% non-schedular rate (TDIU), but wants to be 100% schedular rated instead of TDIU).

Out-of-Pocket Expenses: Sometimes the veteran may want to hire medical and vocational experts to win the veterans VA disability claims or VA appeal.

Those expenses are paid directly to the providers and/or experts by the veteran at the time of service.

Usually, the reports needed by these providers and/or experts don’t cost that much compared to Non-Accredited individuals and programs that require a membership fee, however this is a choice for the veteran to consider and determine on the veteran’s own free will.

Other examples of possible expenses are:

  • If Veteran Claims Agent (VCA) has to travel for a hearing.
  • If Veteran Claims Agent (VCA) has to do printing.
  • If Veteran Claims Agent (VCA) has to do faxing.
  • If Veteran Claims Agent (VCA) has to pay medical records fees.
  • If Veteran Claims Agent (VCA) has to pay for military records fees.
  • If Veteran Claims Agent (VCA) has to pay court fees.
  • If Veteran Claims Agent (VCA) has to do photocopying.
  • If Veteran Claims Agent (VCA) has to pay for postage.
  • If Veteran Claims Agent (VCA) has to pay for messenger and/or delivery services.

for the Veterans appeal.

If the Veterans appeal is not successful, the Veteran may apply to have these expenses waived on a case-by-case scenario.

Veteran Claims Agent (VCA) are Veteran claims agents, which means Veteran Claims Agent (VCA) prepares, presents and prosecutes VA claim(s) and/or VA appeal(s).

Veteran Claims Agent (VCA) services include finding providers to provide VA Nexus Letters, VA DBQs (Disability Benefits Questionnaire) and/or VA IMOs (Independent Medical Opinions) for the Veteran, however Veteran Claims Agent (VCA) does not write the IMOs or nexus letters ourselves.

A “nexus” for a veterans disability VA claim and/or VA appeal is a link or connection between two or more things.

The purpose of the NEXUS Letter is to make the connection between the Veterans current medical disability and either a service-connected condition, an event related to the veteran’s military service, or an aggravation by a currently service connected disability.

A successful VA IMO (Independent Medical Opinion) or VA Nexus Letter is drafted by a medical professional or expert, has an affirming statement reviewing the veteran’s medical history, provides supporting evidence, references to medical/scholarly research, and ends with specific VA desired language that confirms their medical opinion with probative value.

Ideally, a VA IMO (Independent Medial Opinion) or VA Nexus Letter would come from the veteran’s primary care physician.

But in most cases, especially if the VA is treating the Veteran, this is not feasible.

Why? Because VA doctors are generally dissuaded from writing VA IMOs (Independent Medical Opinions) or VA Nexus Letters or giving any opinions about the service connection of the Veterans disability.

In addition to this, many private civilian healthcare providers are unwilling to write VA IMOs (Independent Medical Opinion) and VA Nexus Letters because they do not understand the VA claims/appeals process.

VA IMOs (Independent Medical Opinions) or VA Nexus Letters can be very beneficial after a negative C&P examination and for VA appeals, especially if the examiner found no evidence between the claimed condition and the Veterans military service.
